Plain-language summary

Gocut is a technology platform that connects you with lifestyle and wellness establishments. Gocut is not the service provider — the salon, spa, or studio you book with is. By using Gocut you agree to these Terms and our Privacy Policy. Please read both carefully before using the app.

1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you and Gocut Cares ("Gocut," "we," "us," or "our"), governing your access to and use of the Gocut mobile application and website (collectively, the "Platform").

By downloading, installing, or using the Gocut app, or by accessing any part of our website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Platform and should uninstall the application immediately.

If you are accessing the Platform on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

2. Definitions

  • "Platform" means the Gocut mobile application (iOS and Android) and website at Gocutcares.com.
  • "Client" means any individual who uses the Platform to discover, browse, or book lifestyle and wellness services.
  • "Partner Establishment" means any salon, spa, nail studio, tattoo parlour, brow & lash bar, skincare clinic, or other lifestyle/wellness business that is listed on and operates through the Platform.
  • "Booking" means a confirmed appointment between a Client and a Partner Establishment facilitated through the Platform.
  • "Services" means the lifestyle and wellness treatments (haircuts, spa treatments, nail art, tattooing, facials, etc.) rendered by Partner Establishments to Clients.
  • "Gocut Cares Standard" means the quality and hygiene criteria that every Partner Establishment must meet before and during its listing on the Platform.
  • "User Content" means any text, ratings, reviews, photos, or other material submitted by a Client or Partner Establishment through the Platform.

3. Eligibility

To use the Gocut Platform you must:

  • Be at least 13 years of age. Users under 18 must have the consent of a parent or legal guardian to use the Platform and make bookings.
  • Have a valid mobile phone number that can receive SMS for account verification.
  • Not be barred from receiving services under the laws of India or any other applicable jurisdiction.
  • Not have had a Gocut account previously terminated for a violation of these Terms.

By using the Platform, you represent and warrant that you meet all of the above eligibility requirements.

4. Account Registration & Security

You must create an account to make bookings. During registration you agree to provide accurate, current, and complete information including your full name, email address, and mobile phone number. You are responsible for keeping this information up to date.

Account Security

  • Keep your account credentials confidential. Do not share your account with any other person.
  • You are solely responsible for all activity that occurs under your account, whether or not authorised by you.
  • Notify us immediately at support@Gocutcares.com if you suspect any unauthorised access to or use of your account.

Account Integrity

  • You may hold only one Client account. Duplicate accounts may be suspended.
  • You may not impersonate any person, organisation, or establishment.
  • Gocut reserves the right to verify your identity at any time and to suspend accounts where verification fails.

5. The Gocut Platform

Gocut is an intermediary platform, not a service provider.

Gocut is a technology marketplace that enables Clients to discover and book appointments with independent Partner Establishments. Gocut does not itself provide any salon, spa, tattoo, or wellness services. The actual Services are provided solely by Partner Establishments, who are independent businesses and not employees, agents, or representatives of Gocut.

Gocut operates as an intermediary under the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We do not create, publish, or own the listings or content posted by Partner Establishments, and we are not responsible for the quality, safety, legality, or availability of any Services offered by them.

What Gocut Provides

  • A searchable directory of vetted lifestyle and wellness establishments.
  • Real-time availability and appointment booking functionality.
  • Secure payment processing for confirmed bookings.
  • Push notifications for booking confirmations, reminders, and updates.
  • A review and rating system to help Clients make informed choices.

What Gocut Does Not Provide

  • Any salon, spa, nail, tattoo, skincare, or other personal care service.
  • Guarantees regarding the quality, outcome, or safety of Services rendered by Partner Establishments.
  • Direct communication channels between Clients and Partner Establishments through the app (all communication beyond booking confirmations and notifications is the responsibility of the parties directly).

Location Requirement

Location access is required for the Platform's core functionality — without it, the app cannot display establishments near you. By granting location permission you consent to the use of your device location as described in our Privacy Policy.

6. Booking Policy

When you complete a booking through the Platform:

  • A legally binding appointment is created between you and the Partner Establishment. Gocut is not a party to this service agreement.
  • You will receive a push notification confirming your booking details including the establishment name, date, time, and service(s).
  • You agree to arrive on time for your appointment. Late arrivals may result in a shortened or refused service at the Partner Establishment's discretion.
  • You agree to pay the full amount displayed at the time of booking, inclusive of any applicable taxes.
  • Any additional services requested at the establishment that were not part of the original booking may be charged directly by the establishment.

Gocut facilitates the booking but is not liable for any failure by the Partner Establishment to honour the appointment, or for the quality of the Services received.

7. Cancellations & No-Shows

Cancellation by Client

  • Each Partner Establishment sets its own cancellation policy, which is displayed on the establishment's listing page before you confirm a booking.
  • By confirming a booking, you accept the applicable cancellation policy of that Partner Establishment.
  • If you cancel within the permitted window, any applicable refund will be processed in accordance with Section 9.
  • Cancellations outside the permitted window may result in a cancellation fee charged by the establishment.

No-Show by Client

  • Failure to attend a confirmed booking without prior notice constitutes a no-show.
  • The Partner Establishment may charge a no-show fee as stated in their policy.
  • Repeated no-shows may result in restrictions on your ability to book on the Platform.

Cancellation by Partner Establishment

  • If a Partner Establishment cancels a confirmed booking, you will be notified by push notification as promptly as possible.
  • In such cases you will receive a full refund of any amount paid.
  • Gocut reserves the right to review the standing of Partner Establishments that repeatedly cancel confirmed bookings.

8. Gocut Cares Standard

Every establishment listed on Gocut must meet and continuously maintain the Gocut Cares Standard — our quality and hygiene benchmark — before and during their presence on the Platform. This standard requires:

  • Sanitized tools and surfaces compliant with applicable health and safety regulations.
  • Trained, professional staff with appropriate qualifications for the services offered.
  • Transparent and accurate service menus with clear pricing and no hidden charges.
  • Consistent care that respects the dignity, safety, and time of every Client.

Gocut reserves the right to delist, suspend, or permanently remove any Partner Establishment that fails to maintain the Gocut Cares Standard, without prior notice. Meeting this standard is the responsibility of the Partner Establishment. Gocut makes reasonable efforts to verify compliance but does not guarantee that every establishment on the Platform meets these standards at all times.

If you experience a hygiene or safety concern at a Gocut partner, please report it immediately to support@Gocutcares.com.

9. Payments & Refunds

Payment Processing

  • All payments are processed through a PCI-DSS-compliant payment gateway. Gocut does not store, process, or transmit your full card number, CVV, or UPI PIN.
  • By initiating a payment you authorise Gocut's payment gateway to charge your selected payment method for the stated amount.
  • Prices displayed on the Platform are inclusive of applicable taxes unless stated otherwise.

Refunds

  • Cancellation within the permitted window: Full refund to the original payment method within 5–7 business days.
  • Partner Establishment cancellation: Full refund to the original payment method within 5–7 business days.
  • Cancellation outside the permitted window: Refund (if any) subject to the Partner Establishment's cancellation policy.
  • No-show by Client: No refund; any applicable no-show fee will be charged.
  • Service quality disputes: Disputes regarding the quality of a service rendered must be raised with the Partner Establishment first. If unresolved, you may escalate to Gocut at support@Gocutcares.com within 7 days of the appointment. Gocut will review disputes and may, at its sole discretion, facilitate a partial or full refund.

Payouts to Partner Establishments

Payouts to Partner Establishments are processed after the successful completion of a booking, minus any applicable platform service charges as agreed in the Partner Establishment's agreement with Gocut.

10. Partner Establishment Obligations

By listing on Gocut, each Partner Establishment agrees to:

  • Hold all licences, certifications, and registrations required under applicable Indian law (including GST registration where applicable) for the services offered.
  • Maintain the Gocut Cares Standard at all times (see Section 8).
  • Provide accurate, truthful, and up-to-date information about services, pricing, availability, and opening hours.
  • Honour all confirmed bookings or provide advance notice of cancellation with the maximum possible lead time.
  • Treat all Clients with dignity and professionalism.
  • Keep Client personal information confidential and use it only for the purpose of fulfilling the booked Service — not for unsolicited marketing or any other purpose.
  • Not solicit Clients to circumvent the Platform or avoid platform service charges.
  • Comply with all applicable consumer protection laws, including the Consumer Protection Act, 2019.

Partner Establishments are independent businesses and are not employees, agents, or partners of Gocut. Gocut is not liable for any act or omission of a Partner Establishment.

11. User Conduct

You agree to use the Platform in a lawful, respectful, and honest manner. In particular:

  • Treat Partner Establishment staff and other users with courtesy and respect.
  • Submit only honest reviews based on genuine personal experience.
  • Provide accurate information when registering and making bookings.
  • Honour your bookings or cancel them within the applicable cancellation window.
  • Report any safety or hygiene concern at a Partner Establishment to Gocut promptly.
  • Use the Platform only for personal, non-commercial booking purposes unless you are an authorised Partner Establishment.

12. Prohibited Activities

The following are strictly prohibited on the Platform:

  • Using the Platform for any purpose that is unlawful under Indian law or any other applicable jurisdiction.
  • Posting false, fabricated, or misleading reviews or ratings.
  • Harassing, threatening, defaming, or abusing any Partner Establishment staff, other user, or Gocut employee.
  • Attempting to gain unauthorised access to any part of the Platform, another user's account, or our backend systems.
  • Introducing malware, viruses, bots, scrapers, or any other harmful or disruptive code.
  • Impersonating any person, establishment, or organisation.
  • Using the Platform to conduct or facilitate any fraudulent transaction.
  • Reverse-engineering, decompiling, or otherwise attempting to extract source code from the Platform.
  • Reproducing, distributing, or creating derivative works from any part of the Platform without written authorisation from Gocut.
  • Using automated means (bots, scripts, scrapers) to access, query, or interact with the Platform.

Violations may result in immediate account suspension or termination and, where appropriate, referral to law enforcement authorities under the Information Technology Act, 2000 or other applicable law.

13. User Content

"User Content" includes any reviews, ratings, photos, or other material you submit through the Platform.

  • By submitting User Content, you grant Gocut a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and distribute that content in connection with operating and promoting the Platform.
  • You represent that your User Content is accurate, reflects genuine personal experience (for reviews), does not infringe any third-party intellectual property rights, and does not contain unlawful, offensive, defamatory, or harmful material.
  • Gocut reserves the right to remove, edit, or decline to publish any User Content that violates these Terms or our community standards, without notice or liability.
  • You retain ownership of your User Content. Gocut's licence to use it terminates when you delete it or delete your account, except where it has already been reproduced in connection with Platform operations.

14. Intellectual Property

The Gocut Platform — including its name, logo, design, software, text, graphics, and all other content created by Gocut — is owned by or licensed to Gocut Cares and is protected under Indian and international intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for the purposes permitted under these Terms. This licence does not include the right to:

  • Copy, reproduce, or distribute any part of the Platform.
  • Modify, translate, or create derivative works.
  • Commercially exploit any content from the Platform without our prior written consent.
  • Remove or alter any proprietary notices, labels, or marks.

Any unauthorised use of Gocut's intellectual property is strictly prohibited and may be subject to legal action.

15. Disclaimers

The Platform is provided "as is" and "as available."

To the maximum extent permitted by applicable law, Gocut makes no warranties — express, implied, or statutory — regarding the Platform, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

  • Gocut does not warrant that the Platform will be uninterrupted, error-free, virus-free, or available at any particular time.
  • Gocut does not warrant the accuracy, completeness, or reliability of any information provided by Partner Establishments, including service descriptions, pricing, photos, or reviews.
  • Gocut does not vet, certify, or guarantee the qualifications, competence, hygiene practices, or business conduct of any Partner Establishment beyond the Gocut Cares Standard assessment process.
  • The quality, safety, and outcome of any Service rendered by a Partner Establishment is the sole responsibility of that establishment. You engage Partner Establishments at your own risk.
  • Gocut is not responsible for any physical or personal harm arising from Services rendered by a Partner Establishment.

16. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Gocut Cares and its directors, officers, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
  • Any loss of data, revenue, profits, business, or goodwill.
  • Any personal injury or property damage arising from Services rendered by a Partner Establishment.
  • Any unauthorised access to or alteration of your data or account resulting from circumstances beyond Gocut's reasonable control.
  • Any acts or omissions of Partner Establishments.

In no event shall Gocut's total aggregate liability to you exceed the total amount you paid through the Platform in the three (3) calendar months preceding the event giving rise to the claim, or ₹5,000 (Indian Rupees Five Thousand), whichever is greater.

Nothing in these Terms limits Gocut's liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

17. Indemnification

You agree to defend, indemnify, and hold harmless Gocut Cares and its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Platform.
  • Your User Content.
  • Your violation of these Terms.
  • Your violation of any applicable law or the rights of any third party.
  • Any dispute between you and a Partner Establishment.

Gocut reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of these claims.

18. Termination

Termination by Gocut

Gocut may suspend or permanently terminate your account and access to the Platform at any time, with or without prior notice, if:

  • You breach any provision of these Terms.
  • We reasonably believe that your account is being used fraudulently or in a manner harmful to other users or the Platform.
  • Required by applicable law or a competent authority.
  • We discontinue the Platform or any part of it.

Termination by You

You may delete your account at any time by submitting a deletion request to support@Gocutcares.com. Upon deletion, your access to the Platform will cease and your personal data will be handled in accordance with our Privacy Policy.

Effect of Termination

Upon termination, any outstanding bookings will be cancelled and any eligible refunds processed. Sections 13 (User Content licence), 14 (Intellectual Property), 15 (Disclaimers), 16 (Limitation of Liability), 17 (Indemnification), and 19 (Governing Law) shall survive termination.

19. Governing Law & Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of India, including but not limited to the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.

Informal Resolution

Before initiating any formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@Gocutcares.com with a description of your complaint. We will make reasonable efforts to resolve the dispute within 30 days.

Consumer Forum

Nothing in these Terms prevents you from filing a complaint with the relevant Consumer Disputes Redressal Forum or Commission under the Consumer Protection Act, 2019, or approaching any other statutory authority as permitted by Indian law.

Arbitration

If a dispute cannot be resolved informally within 30 days, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, seated at New Delhi, India, and conducted in the English language.

Jurisdiction

Subject to the arbitration clause above, you irrevocably submit to the exclusive jurisdiction of the courts located in New Delhi, India for any matter not subject to arbitration.

20. Changes to These Terms

Gocut may update these Terms from time to time to reflect changes in our services, business practices, or applicable law. When we make material changes, we will:

  • Send a push notification to the app at least 14 days before the changes take effect.
  • Update the "Last updated" date at the top of this page.
  • Where required by law, seek your fresh consent for any material change in how your data is processed.

Your continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform and may request account deletion before the effective date.

21. Grievance Officer & Contact

In accordance with the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection Act, 2019, Gocut has designated a Grievance Officer to receive and redress user complaints.

If your grievance is not resolved to your satisfaction, you may approach the appropriate Consumer Disputes Redressal Forum, the Data Protection Board of India (once constituted), or any other competent authority under applicable Indian law.
